Caso a empresa levante o C11, então adeus dinheiro.

PAulo, hoje pode ser um grande dia para ti.
Na verdade, o Juiz decide hoje muita coisa.

NEW YORK - MCI Communications is expected to have its restructuring plan approved this afternoon, according to a source close to the proceedings. Judge Arthur Gonzalez of the U.S. Bankruptcy Court for the Southern District of New York is making a final review of the company's emergence from Chapter 11 bankruptcy, entered last July 21 as WorldCom.

Desejo-te muita sorte. Se o plano for aprovado, bem podes trocar de casa, de carro, boas férias, etc.
So por curiosidade, posso dizer-te que neste momento sobe 15% e o ticker para acompanhares é WCOEQ

Eu punha-as no cofre...

por JCS » 29/10/2003 20:08

Pelo que valem eu ficava com elas. O sr.

Cumprimentos

On April 14, 2003, WorldCom Inc. and substantially all of its active U.S. subsidiaries submitted a Joint Plan of Reorganization to WorldCom's creditors and the Bankruptcy Court for the Southern District of New York. The plan included a three-year business plan outlining the future plans for WorldCom.

This was the culmination of our 100 Day Plan to refocus our efforts and begin the process of emerging as a stronger, more efficient and more responsible company, committed to integrity, innovation and value. During the Chapter 11 process, WorldCom is continuing to provide services and support of the highest quality to our millions of customers around the world.

We have developed this list of answers to commonly asked questions so our customers and vendors can familiarize themselves with the bankruptcy filing and the restructuring process.

General Chapter 11 Information
WorldCom's Business Within the U.S.
WorldCom's Business Outside the U.S.
WorldCom's Vendors/Suppliers
Proof of Claim

General Chapter 11 Information
1. Q: What is Chapter 11?

A: WorldCom and substantially all of its active U.S. subsidiaries filed under Chapter 11 of the Bankruptcy Code, which allows the company to operate our business while it developed a plan for resolving our financial problems. We did this by filing a voluntary petition for reorganization. WorldCom is reorganizing the company under bankruptcy protection from some pre-filing financial liabilities.

2. Q: Do companies emerge from Chapter 11 and survive?

A: Yes. Chapter 11 of the Bankruptcy Code is often used by a company that has a fundamentally strong business and loyal customer base to restructure its financial position and debts to strategically strengthen its businesses. WorldCom falls into this category. This is a viable option for WorldCom to reorganize its businesses and re-focus to become profitable again.

3. Q: How does a company exit Chapter 11?

A: Upon confirmation of a Chapter 11 Plan by the court, all assets will vest in the reorganized company and pre-bankruptcy claims will be discharged. The company will have emerged from Chapter 11. The company will continue to operate according to the terms of Chapter 11 Plan.

4. Q: Have additional WorldCom subsidiaries filed for U.S. Chapter 11 Bankruptcy protection?

A: Yes, on November 8, WorldCom filed U.S. Chapter 11 Bankruptcy petitions for 43 additional subsidiaries, most of which were effectively inactive and none of which had significant debt. The company made the decision to file the additional entities in order to provide them with the same relief under Chapter 11 as its other businesses.

WorldCom's Business Within the U.S.
5. Q: Will WorldCom close facilities?

A: WorldCom will remain strongly committed to our core operations and businesses. We will, however, restructure and divest any non-core and non-competitive assets and facilities. This restructuring is an opportunity for the company to continue to focus on our core businesses to better serve customers.

6. Q: Does bankruptcy status change current customer contracts?

A: WorldCom will continue to provide the high level of services our customers demand. We will continue to provide services per our contractual commitments and expect our customers to honor those agreements.

7. Q: What are WorldCom customers saying?

A: As our recent operating reports show, a large number of our customers have continued to stand by us. Indeed, customers appreciate and still benefit from the competition in the marketplace that WorldCom provides.

8. Q: What is WorldCom doing to ensure network integrity for customers?

A: WorldCom continues to operate its networks at the same level of performance as prior to the Chapter 11 filing. WorldCom has not experienced and does not expect discontinuity of service or major network outages during the Chapter 11 period.

9. Q: How will Chapter 11 impact outstanding credits that are owed to customers?

A: Customers will continue to receive credits in the ordinary course of business.

10. Q: Should business customers feel confident in signing long or short-term contracts with WorldCom?

A: WorldCom is the second largest telecommunications company in the U.S. We deliver mission-critical networks to tens of thousands of businesses on a global scale and good value long distance telecommunications services to millions of U.S. consumers. The company also runs a significant portion of the global infrastructure that underpins the Internet. These are valuable assets that are unique in the marketplace. They form the basis upon which the company looks forward confidently to the future.

11. Q: Can WorldCom guarantee that you won't be raising prices when you are in bankruptcy?

A: Our pricing policies continue to be dictated by market forces, not Chapter 11.

WorldCom's Business Outside the U.S.
12. Q: What does Chapter 11 mean for customers outside the U.S.?

A: There are clear differences between the definitions of bankruptcy in the U.S. and overseas. Chapter 11 provides our U.S. entities the ability to restructure and shore up its financial arrangements. There is not a Chapter 11-equivalent for corporations outside the U.S. Outside the U.S., bankruptcy implies termination of operations without restructuring. WorldCom's non-U.S. entities have not made any such filings.

Regardless, the WorldCom network is fully operational worldwide. The Chapter 11 filing applies only to our U.S. entities. Operations for WorldCom international are business as usual. WorldCom is working to create a restructuring plan and it intends to emerge stronger and more viable than ever.

13. Q. Will overseas customers have the option to terminate the service contract due to the current situation?

A: WorldCom's business operations overseas will continue without interruption. Our commitment to provide quality products and service remains. WorldCom is dedicated to continue fulfilling any contractual agreement with our customers without service interruption. We expect our customers to honor these contracts as well.

14. Q: What effects does filing for Chapter 11 have on creditors in non-U.S. operations?

A: The filing does not affect any WorldCom operations outside of the U.S., as such it is business as usual for these non-U.S. entities. Business will proceed as dictated by respective contracts and agreements.

15. Q: How will customers from outside the U.S. currently having U.S. and global services lines be affected?

A: Regardless of geography, customers will continue to receive service from WorldCom as usual. WorldCom in the U.S., EMEA, and Asia Pacific continues to serve customers in the ordinary course of business.

16. Q: Is WorldCom concerned that their international creditors (e.g. local PTTs) will cease service to WorldCom International because they are not protected by Chapter 11 regulation?

A: No. WorldCom U.S. entities who trade with the PTTs are covered by a Bankruptcy Court order intended to maintain service from the PTTs to the U.S. entities. The relationships between WorldCom non-US entities on the one hand and the PTTs on the other hand are unaffected by the Chapter 11 filing.

17. Q: Has the U.S. committed to funding global operations in Asia Pacific and EMEA until the end of Chapter 11 proceedings?

A: The company has implemented procurement payment teams and cash collection teams to ensure all obligations on an operational basis are met and to be able to maintain a positive cash outlook for operations in each region.

WorldCom's Vendors/Suppliers
18. Q: What is the status of my pre petition invoices?

A: WorldCom is generally prohibited by bankruptcy law from paying any amounts due for services rendered and goods delivered prior to filing for bankruptcy on July 21 without bankruptcy court approval. Pre-Chapter 11 claims are paid after confirmation of the Chapter 11 Plan and in accordance with the Plan.

19. Q: What is the case number and court of jurisdiction?

A: The case was filed in the United States Bankruptcy Court, Southern District of New York. The case number is # 02-13533. You can get information on-line at http://www.nysb.uscourts.gov/.

20. Q: Will I get paid on time for post-petition invoices?

A: Going forward, our vendor relationships are not affected and bankruptcy protects you by requiring that we pay for goods and services in the normal course of business. You should ensure that your company has a current purchase order in place to pay for any services. You may do this by calling our Procurement Help Desk at 1-877-314-1729.

21. Q: My company is a reseller and owed commissions for sales prior to bankruptcy. What is the process to collect these?

A: Questions regarding commissions may be directed to Extcommsupport@lists.wcom.com.

22. Q: I am interested in buying equipment that you might sell.

A: Pics Telecom Corporation handles the sale of WorldCom assets that are no longer deployed. You can call Scott Domuracki at 800-521-7427 extension 258 or visit their Web site at http://www.picstelecom.com.

23. Q: Have you made a decision regarding which real estate leases you plan to keep?

A: We are evaluating all WorldCom real estate and will be contacting agents as we go through this evaluation process. There is no estimated timeframe for this to occur. Agents will be contacted through the same Bankruptcy notification process concerning decisions related to each property. Certain facilities will involve contact with the agents by WorldCom, or its advisors, in addition to notice of decisions through the bankruptcy process.

24. Q: How do we get selected as a critical vendor?

A: According to the motion filed in court and available on-line, the critical vendors will be identified by the senior management of WorldCom's business units. The bankruptcy court capped the total amount the company may pay to critical vendors.

25. Q: Where can I find a list of the unsecured creditor committee?

A: All documents pertaining to the bankruptcy case are being published at http://www.elawforworldcom.com/Worldcomdefault.asp.
