Brazilian Government Clears Microsoft in Competition Case
June 05, 2004 12:43:00 PM ET

Company has been cleared of allegations of anti-competitive behavior in the country's software segment. Microsoft has worked with transparency in the past 6 years to solve the case

SAO PAULO, Brazil, June 5 /PRNewswire-FirstCall/ -- The Brazilian government has cleared Microsoft under the accusation of preventing competition in the software sector. The Economic Defense Administration Board (CADE), the Brazilian organ tied to the Justice Ministry and responsible for ruling on questions regarding market competition, will publish the decision in the following days in the official press. The decision can be reached over the Internet, at: http://www.cade.gov.br/julgados/microso ... 2-1998.pdf.

Microsoft, which trades the personal finance software Money, was accused by the Brazilian software house Paiva Piovesan of impeding the competitiveness of the Finance program, produced in this country. The CADE councilors took the decision unanimously in favor of Microsoft on 19th May, based on the opinion of the case reporter, who recommended the filing of the process. The case opened in 1998. The councilors ruled definitively only on 19th of last month.

"It is Microsoft's priority to conduct its business in a respectful manner and in agreement with the laws and regulations of the countries it operates in. We have acted responsibly while seeking to build the best products and services we can to meet the needs of our customers", declared Rinaldo Zangirolami, Senior Attorney of Microsoft Brazil. "We have collaborated over the past six years with the Brazilian authorities and we are very pleased with the outcome of the case."

Microsoft is committed to conducting its business strategy with transparency around the world. With this commitment, the company has worked with regulators in America, Europe and Asia to address questions and to ensure its business practices are in full compliance with all laws and regulations. In every case, Microsoft works closely to the justice and acts responsibly, listening to authorities, customers and partners.

"We are committed to Brazil and our customers, building a more constructive relationship with the government of Brazil and other South American governments", said Luiz Sette, Senior Attorney for Microsoft Latin America. "We are pleased the Brazilian government has cleared us of these allegations and we look forward to our continued efforts to address shared concerns that impact Brazil and South America."

Microsoft set to appeal EU ruling against it
June 06, 2004 10:12:00 AM ET

By David Lawsky

BRUSSELS, June 6 (Reuters) - Microsoft Corp (MSFT) says it will ask a European court this week to suspend parts of the European Commission's landmark decision that ordered it to stop business practices that violate antitrust law.

As part of an appeal against the EU executive's decision, Microsoft will ask the Court of First Instance to suspend requirements that it strip Media Player software from its Windows operating system and share information so rival makers of computer servers can more easily compete.

"We intend to file our appeal with the Court of First Instance next week and believe we have a very strong case to present," a Microsoft spokesman said late last week.

The Commission issued a sweeping 302-page ruling against Microsoft on March 24, finding the company abused its dominance, and ordered that it change its business practices and pay a 497 million euro ($606.4 million) fine.

The commission gave Microsoft 90 days to separate its Windows Media Player, which plays music and videos over the Internet, from its Windows operating system.

It would be up to computer makers to decide whether to ship Windows with the Windows Media Player or that of a rival, such as RealNetworks (RNWK) Real Player.

The Commission also gave Microsoft 120 days to license interconnection software to ease the way for rivals to hook up their servers to Windows as easily as Microsoft does.

The Commission said Microsoft once provided the information to makers of network software -- which is used to print documents in offices and share files -- but pulled back when Microsoft began making its own competing products.

Microsoft said on the day the Commission decision was announced it would seek to put remedies on ice until the case was decided, which could be years.

"We will ask the Court of First Instance to stay or suspend at least some of the sanctions that were announced," Microsoft general counsel Brad Smith said.

The deputy general counsel of Real Networks -- which stands to gain ground from the Commission ruling -- opposes any delay.

"Microsoft's attempt to delay the effectiveness of the Commission's decision would simply enable it to continue its illegal conduct, harming competition and restricting the choices available to consumers," said Dave Stewart.

Bo Vesterdorf, president of the Luxembourg-based court, will decide on the suspensions, based in part on documents filed secretly by both sides. Unlike the United States, court documents are closed to the public in the EU.

Vesterdorf may, as he has at times in the past, urge the parties to choose a fast track decision which would take less than a year.

The Commission would have to voluntarily suspend its remedies and Microsoft would have to boil down the issues in its appeal to perhaps three central points.

In the past, Microsoft has shown reluctance to speed things up. In this case it would mean narrowing the arguments available to the company.

"We are going to take as much time as we are allowed to take," Microsoft European Chief Executive Officer Jean-Philippe Courtois told Reuters last year.

Microsoft's Smith has said the company wants to settle. A delay would allow it to wait for a new competition commissioner, who will be appointed later this year.

The Commission contends Microsoft wants a delay because it allows the company to continue anti-competitive practices and grab more market share until the remedies become irrelevant. REUTERS
